I. Right for reclamation

  1. Seller is responsible for incompliance of goods to the contract which appears within two years after the risk transfer to Buyer. 
  2. When taking over the goods, Buyer is obliged to visually examine and points on potential visible damages (broken bottle, damaged label) to the courier, as after that, complaint for physical damage will not be approved. 

II. Process of reclamation for incompliance (Flaw/Malfunction)

  1. If the flaw on the product is identified (e.g. the wine with the flaw – defect), Buyer is obliged to send complaint by e-mail to ofice@mackovpodrum.co.rs or by contact form, in the shortest period possible. 
  2. Reclamation must contain: Name and surname of the Buyer, Number of invoice / order, description of the flaw and a photo (if possible). 
  3. Seller is due to respond to reclamation in written form within 8 days from receiving reclamation.
  4. If the reclamation is justified, Buyer has the right for replacement, repair or refund, in compliance with the Consumer protection law. 

III. Withdrawal from purchase (One-sided breach of contract)

  1. Buyer has the right to withdraw from purchase without stating the reason, within 14 days since the day the goods were delivered. 
  2. Terms of returning goods:
    • Wine has to be returned in original packaging.
    • Bottle must not be open (cork and/or foil undamaged).
    • Goods must be undamaged.
  3. Costs of return: Direct cost of return borne by the Buyer. 
  4. Refund: Seller is due to refund the money within 14 days since the day when Withdrawal statement was received, if the products were received back and if it is eligible for refund. Refund is executed with the say method with which it was paid by the Buyer.
